  • 03.01.12, Tempo is to compensate Eyal Berkovic, Globes
     

The Tel Aviv District court awarded Eyal Berkovic and his partner Ilan Triger 400,000 NIS in a lawsuit filed against Tempo. Berkovic and Triger sued for 6 million NIS claiming that Tempo violated an exclusive agreement to import Bacardi Breezer drink to Israel when it entered into a direct contract with Bacardi Martini, the manufacturer of the drink, to import the drink to Israel.

 

The affair began in 1996, when Berkovic, then an active football player, saw a business opportunity to bring the drink to Israel. Berkovic contacted Triger, an entrepreneur in the alcoholic beverages field for a joint venture.

 

In the claim, filled by Adv. Menachem Abramovich, the two claimed that they had acted diligently to promote the importation of the drink to Israel and for this purpose, signed an exclusive agreement with Tempo. According to Berkovic and Triger, Tempo went "over their heads" and signed a deal with Bacardi to get the exclusive franchise rights to distribute the drink in Israel.

 

Tempo claimed only few meetings took place and that during those meetings, Berkovic and Triger only wanted to help Tempo to market the drink. According to Tempo, Berkovic and Triger were attempting to unjustly enrich on its expense.

 

Judge Avi Zamir concluded that while Berkovic and Triger did all they can to promote cooperation between the parties, the two failed to show a final agreement with Tempo. However, since the two were clearly the "trigger" for the agreement with Tempo and Bacardi, they are entitled to retribution for their efforts, and awarded the two, 400,000 NIS.
