Some of the cases managed by the Department have involved precedent-setting issues with extensive implications, that positioned the firm at the forefront of the business and legal community in Israel. The Litigation Department has, inter alia, been involved in the setting of many legal precedents at the Supreme Court in the areas of corporate law and insolvency law, real estate, contract law, banking law, arbitration law and civil procedure. These important issues include the nature of building rights for purposes of the statute of limitations; the inherent authority of the court to grant procedural relief; the limits of the court’s jurisdiction to revisit interim decisions; and stay of proceedings in international arbitrations. Precedent-setting rulings under insolvency law achieved by the team include the classification of creditors for purposes of approval of compositions with creditors, and a case concerning the court’s intervention in the discretion of a trustee in a composition with creditors.

The Department has particular expertise in banking litigation, and it provides legal representation to a good number of the largest commercial banks in Israel on numerous and varied issues.
